These Terms and Conditions apply to orders placed through the online shop operated at dpfcontrol.eu.

2. Scope

M.S. Deutschland sells automotive products via the internet (e-commerce).

3. Orders and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By placing an order in the online shop, the customer submits a binding offer to purchase the selected goods.

The contract is concluded when the seller accepts the order. Acceptance may take place by an order confirmation, a shipping confirmation, or by dispatch of the goods.

These Terms and Conditions are available at any time on the website and can be saved or printed by the customer.

4. Prices, Shipping and Payment

The product price shown in the shop is the price valid at the time of purchase.

Unless expressly stated otherwise, product prices do not include shipping costs.

Shipping costs are shown during checkout before the order is completed and are added to the product price.

The customer pays the total amount shown at checkout, including any applicable shipping costs.

Deliveries are currently offered to the following countries: Austria, Belgium, Switzerland, Czechia, Germany, Denmark, Spain, France, United Kingdom, Greece, Hungary, Ireland, Italy, Netherlands, Portugal, Romania, Slovakia and Turkey.

Shipping is carried out using the shipping methods offered during checkout.

Personal collection may be possible only by prior arrangement.

The customer may choose from the payment methods offered during checkout.

5. Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason.

For goods, the withdrawal period is 14 days from the day on which the customer, or a third party named by the customer who is not the carrier, takes possession of the goods.

To exercise the right of withdrawal, the customer must inform us by a clear statement, for example by email to info@dpfcontrol.eu, of the decision to withdraw from the contract.

To help us process the withdrawal quickly, the customer should include:

  • full name,
  • order number,
  • description of the goods,
  • email address used for the purchase,
  • purchase date.

The customer bears the direct cost of returning the goods.

Returns are accepted only for goods ordered from our shop. Unrelated items or materials that were not part of the order will not be accepted.

If reasonably possible, the returned goods should be sent back in the original packaging. If the original packaging is no longer available, suitable protective packaging should be used.

The returned goods must be sent back in a condition that allows inspection of the return.

In the case of sets or bundles, the complete set or bundle must be returned. Partial returns of individual items from a set are not accepted.

Refunds are made without undue delay and no later than 14 days after we are informed of the withdrawal.

We may withhold reimbursement until we have received the returned goods or until the customer has supplied evidence of having sent back the goods, whichever is earlier.

Refunds are made using the same payment method that was used for the original transaction, unless expressly agreed otherwise.

Exchange requests may be reviewed upon prior email contact and subject to product availability.

7. Warranty and Complaints

Statutory consumer rights remain unaffected.

If the customer receives defective goods or if a product develops a defect, the customer may contact us at info@dpfcontrol.eu.

Where a defect is covered by applicable law or by any voluntary commercial warranty expressly offered by us, we will handle the claim in accordance with the applicable legal rules.

Any voluntary commercial warranty offered by us does not limit mandatory statutory rights.

Damage caused by improper installation, improper use, unauthorised opening of the device, or mechanical damage after delivery may exclude a voluntary commercial warranty, without affecting any mandatory statutory consumer rights.

8. Liability

We are liable without limitation in cases of intent, gross negligence, injury to life, body or health, and in all other cases where liability is mandatory under applicable law.

In cases of slight negligence, we are liable only for breach of essential contractual obligations and only for foreseeable damage typical for the contract.

We are not liable for damage resulting from improper installation, improper use, use outside the intended purpose, or mechanical damage occurring after delivery, unless liability is mandatory by law.

9. Data Protection

The customer provides personal data for the purpose of order processing and customer service.

Customer data is processed only to the extent necessary for order handling, payment processing, shipping, customer service and compliance with legal obligations.

Customer data may be shared, where necessary, with shipping companies and payment service providers involved in processing the order.

10. Storage of Contract Text

These Terms and Conditions are available on the website and may be saved or printed by the customer.

Order data may also be stored by the seller to the extent required by applicable law and business operations.

11. Contract Language

The legally relevant contract language is German. This English version is provided for information and transparency. In the event of discrepancies, the German-language version shall prevail, unless mandatory consumer law provides otherwise.

12. Out-of-Court Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory law provides otherwise.

13. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection rules of the country where the customer habitually resides provide otherwise.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be Bamberg, Germany, where legally permissible. For consumers, the statutory rules on jurisdiction remain unaffected.
